Terms & Conditions

Last Updated: April, 2025

Welcome to Hunny Nanny Agency. By using our website and engaging our referral services, you agree to the following terms and conditions. Please read them carefully.

1. Agency Role and Scope of Services

Hunny Nanny Agency is a referral and matchmaking service that connects families with independent childcare providers. We are not the employer of any nanny or caregiver introduced through our agency. We do not supervise, direct, or control the day-to-day activities of any nanny once placed.

2. Registration and Referral Fees

Clients are required to pay a non-refundable registration fee to initiate the referral process. Upon hiring a referred candidate, the appropriate referral fee (as outlined in the signed agreement) becomes due. Fee structures and payment timelines are specified in the individual client agreement and all fees are non-refundable.

3. Candidate Screening

Our team conducts a multi-step screening process, which may include:

  • Interviews

  • Reference checks

  • Background checks (covering criminal history, driving records, and sex offender registry searches, typically going back seven (7) years)

Please note: Background check results are limited to what is legally reportable, generally up to seven years. If a candidate has a prior history that does not appear on the background report, Hunny Nanny Agency cannot verify or speak to that information. We rely on third-party reporting agencies for this process and cannot be held responsible for any omissions or inaccuracies in the results provided.

While we take care in vetting candidates, we do not guarantee performance, conduct, or compatibility. Final hiring decisions are the sole responsibility of the client.

4. CPR/First Aid Certification

Candidates are required to hold current CPR and First Aid certification prior to their first day of employment. Families are responsible for verifying this documentation and may request updated certification at any time.

5. Trial Periods and Working Interviews

If you choose to conduct a working interview or trial period, this is at your discretion and must be communicated in advance. The agency must coordinate this. You are responsible for compensating the candidate for their time, and all applicable labor laws must be followed.

6. Employment Relationship

All nannies referred by Hunny Nanny Agency are considered independent hires by the client. As the employer, the client assumes full responsibility for:

  • Employment terms

  • Tax withholding and reporting

  • Payroll processing

  • Insurance, benefits, and termination

Hunny Nanny Agency does not provide legal or tax advice. We encourage clients to consult with a tax or legal professional to remain compliant with household employment laws.

7. Replacement Policy

If a placement ends within the first 120 days, and all terms of the agreement have been upheld, Hunny Nanny Agency will make reasonable efforts to refer additional candidates at no additional referral fee. This policy is subject to caregiver availability and does not guarantee a replacement. Please see the agreement for further details regarding this matter.

Only one replacement search is provided per hire under this policy.

8. Temporary and Gap Care

Upon availability, Hunny Nanny Agency may assist in coordinating temporary or “gap” care services. These arrangements are not guaranteed and are billed separately. If a family uses temporary care and does not proceed with a permanent hire, a daily back-charge may apply. The family is responsible for paying the temporary caregiver directly.

9. Client Responsibilities

Clients agree to:

  • Treat all candidates with professionalism and respect

  • Provide accurate job descriptions and expectations

  • Maintain compliance with local, state, and federal labor laws

  • Communicate openly with the agency throughout the process

10. Limitation of Liability

Hunny Nanny Agency is not liable for:

  • The actions or omissions of any candidate before, during, or after employment

  • Any loss, damage, or legal issues arising from the employment relationship between the family and nanny

  • Any interruptions, delays, or inability to fulfill services due to caregiver availability or force majeure circumstances

11. Modifications

Hunny Nanny Agency reserves the right to update or modify these Terms & Conditions at any time. Any changes will be posted on this page with the updated effective date. It is the responsibility of the client and any referred caregiver to review this page periodically and stay informed of any updates. Continued use of our services constitutes acceptance of the most current version of these Terms & Conditions.

12. Nannies & Caregivers

Hunny Nanny Agency is a referral service only and does not employ any nanny, sitter, or caregiver introduced through our agency. All caregivers are considered independent hires by the families who engage them. As such:

  • We do not make employment decisions on behalf of families.

  • We are not involved in scheduling, compensation, tax withholding, or employment terms.

  • We do not guarantee job placement, hours, or working conditions.

  • We are not responsible for resolving disputes between families and caregivers.

All job offers, contracts, and employment arrangements are directly between the family and the caregiver. We strongly encourage all caregivers to understand their rights and responsibilities and to ensure that terms of employment are clearly outlined in writing before beginning a role.
